Terms of Service & Terms of Sale
These Terms govern your use of the Souls with Soles website and your purchase of our products. Please read them carefully — they include important details about made-to-order and personalized items, which are final sale, as well as limits on our liability and how disputes are resolved. By using our site or placing an order, you agree to these Terms.
1. Acceptance of These Terms
These Terms of Service and Terms of Sale (together, the "Terms") are a binding agreement between you and Souls with Soles ("SWS," "we," "us," or "our"), a footwear house based in Chicago, Illinois, USA.
By accessing or using soulswithsoles.com (the "Site"), creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Site or place an order.
Some purchases — such as made-to-order, custom, or group orders — are also subject to the additional terms set out in the relevant sections below. Where those terms differ from the general Terms, the more specific terms control for that purchase.
2. Eligibility & Accounts
You must be at least 18 years old, or the age of majority where you live, to place an order. Minors may use the Site only with the involvement and consent of a parent or legal guardian, who is responsible for the order.
You can browse and shop as a guest, or create an account using your email address and a password. You may also enable optional two-factor authentication (2FA) for added security, and we encourage you to do so.
You are responsible for keeping your account information accurate and up to date, and for maintaining the confidentiality of your password and any 2FA method. You are responsible for all activity that occurs under your account.
If you reset your password, we will send a reset link to the email address on file. Tell us promptly at support@soulswithsoles.com if you believe your account has been accessed without your authorization. We may suspend or close an account that we reasonably believe has been compromised, used fraudulently, or used in violation of these Terms.
3. Products, Pricing & Availability
We sell heritage sneakers and our custom/blank "Soulless" line. All prices are listed in U.S. dollars (USD) and apply to orders shipped within the United States unless otherwise stated.
Prices, product offerings, and promotions may change at any time without notice. The price that applies to your order is the price displayed at the time you place it and is confirmed in your order confirmation. Applicable sales taxes are calculated and added at checkout based on your shipping destination; you are responsible for those taxes.
We work hard to display our products, colors, and materials accurately, but we cannot guarantee that your screen will show them exactly. Because many items are crafted by hand, slight variations in finish, stitching, and color are normal and are not defects.
Products are subject to availability. We may limit quantities, discontinue items, or correct errors in descriptions, pricing, or availability at any time, including after an order has been submitted.
4. Orders, Acceptance & Payment
When you submit an order, you are making an offer to buy. Your order is not accepted until we send an order confirmation and, for made-to-order items, begin the build. An automated acknowledgment does not by itself mean your order has been accepted.
We may refuse, cancel, or limit any order — in whole or in part — at our discretion. Reasons may include suspected fraud, payment problems, pricing or inventory errors, ordering quantities outside normal retail use, or a violation of these Terms or our content policy.
If we cancel an order after you have been charged, we will refund the amount paid for the cancelled portion to your original payment method, except where an item is final sale and has already entered production as described in Section 5.
Payment is processed by a third-party payment processor. By providing payment details, you authorize us and our processor to charge the full order amount, including taxes and any shipping charges. We do not store full card numbers ourselves. We offer free standard U.S. shipping as advertised; delivery estimates are not guaranteed, and risk of loss passes to you once the carrier takes possession of your order.
5. Made-to-Order, Customization & Resole
Our custom commissions and personalized pairs are made to order. The typical build time is approximately 4–6 weeks from order acceptance, plus shipping. Build times are estimates and may vary with demand and materials.
Because made-to-order, custom, and personalized items are produced specifically for you, they are FINAL SALE. They cannot be returned, exchanged, or refunded once production has begun, except where the item arrives with a manufacturing defect or we sent the wrong item. Please review your size, options, and personalization carefully before you order.
Customization options may include embroidered initials of up to three (3) characters and an optional heritage mark. You are responsible for the accuracy of any initials, characters, or options you submit, including spelling — we produce what you provide. Under our content policy, we reserve the right to refuse, modify, or cancel any customization request that contains profanity, slurs, hate speech, or other content we find unlawful, offensive, infringing, or inconsistent with our brand, and certain initials and terms are restricted under our banned-initials policy. If we decline a customization, we will contact you to adjust the request or cancel and refund that item before production begins.
Our "resoled for life" resole program lets eligible shoes be resoled in-house. Details, turnaround times, and any conditions are described on the relevant Site pages and may be updated from time to time. Resole service does not extend or create any warranty beyond what is stated in these Terms.
6. Group Orders & 10% Match
We offer group orders for organizations and communities. As part of this program, we will match 10% of the value of a qualifying group order back to a church, school, or nonprofit that you designate, subject to the program terms.
To qualify, an order must meet the group-order requirements communicated to you at the time of purchase, and the named recipient must be an eligible church, school, or registered nonprofit. The 10% match is calculated on the eligible product value (excluding taxes, shipping, and any discounts) and is contributed by SWS — it is not a charitable donation made by you and is not tax-deductible to you.
We may verify the designated organization and may decline or adjust a match if the order is cancelled, refunded, or does not meet the program requirements. We may modify or end the group-order match program at any time, but changes will not affect a qualifying order already accepted.
7. Intellectual Property
The Site and its content — including the Souls with Soles name, logos, designs, heritage marks, product imagery, text, and graphics — are owned by SWS or our licensors and are protected by copyright, trademark, and other laws. We grant you a limited, personal, non-exclusive, non-transferable license to access and use the Site for shopping and personal, non-commercial purposes.
You may not copy, reproduce, sell, or commercially exploit any part of the Site or our designs without our prior written permission. If you submit content to us, such as initials, marks, or other customization input, you confirm you have the right to use it and you grant us the rights necessary to produce and fulfill your order. You remain responsible for ensuring your submissions do not infringe anyone else's rights.
8. Acceptable Use
When using the Site, you agree not to: use it for any unlawful or fraudulent purpose; submit customization content that violates our content policy in Section 5; interfere with or disrupt the Site, its security, or its underlying systems; attempt to gain unauthorized access to any account, server, or data; scrape, harvest, or collect data through automated means without our permission; or misuse our promotions, programs, or accounts.
We may investigate suspected violations and take any action we consider appropriate, including removing content, cancelling orders, and suspending or terminating accounts.
9. Disclaimers
The Site and our products and services are provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected. Nothing in these Terms excludes or limits any rights or warranties that cannot be excluded or limited under applicable law, including consumer-protection laws that may apply to you.
10. Limitation of Liability & Indemnification
To the fullest extent permitted by law, SWS and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Site or our products.
To the fullest extent permitted by law, our total liability for any claim arising out of or related to these Terms, the Site, or a purchase will not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.
You agree to indemnify and hold harmless SWS and its owners, employees, and suppliers from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your misuse of the Site, your violation of these Terms or applicable law, or any customization content or other materials you submit to us.
11. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-laws rules. Subject to the paragraph below, you and SWS agree to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois, and you consent to venue there.
Before filing any formal action, please contact us at support@soulswithsoles.com so we can try to resolve the matter informally. Nothing in this section limits any rights you may have under the mandatory consumer-protection laws of the place where you live.
12. Changes to These Terms & Contact
We may update these Terms from time to time. When we do, we will revise the "Last updated" date below, and material changes may be communicated through the Site or by email. Changes apply to use of the Site and to orders placed after the changes take effect; the Terms in effect when you placed an order govern that order. Your continued use of the Site after an update means you accept the revised Terms.
